Nintendo-Genki: Lawsuit Agreement Reached
Refund to be paid and prohibitions for accessory manufacturer
At the beginning of 2025, we were all eagerly awaiting the reveal of the new Nintendo Switch 2 console: naturally, numerous rumors circulated online, but the House of Mario is typically adept at keeping official information under wraps. That is, until the CES 2025 when accessory manufacturer Genki presented at the fair with what appeared in every way to be a prototype of the console.
Although the company defended itself by stating that it was not an official prototype but rather a replica made based on the aforementioned rumors and leaks, Nintendo was not at all pleased with the move, and as is its custom, called in its lawyers.
The lawsuit, which began last May, had a rather short course, as two days ago the two companies announced that they had reached an agreement. "Genki is permanently enjoined from using terms such as 'Glitch', 'Glitch 2', 'Genki Direct', 'Genki Indirect' or any other that may resemble or approximate Nintendo's intellectual property, products, product names, characters, presentations or trademarks, for example for any accessory compatible with or designed for use with Nintendo products, implementing packaging, design and descriptions that do not clearly specify to Genki's customers the status of an officially unlicensed accessory manufacturer." Further in the document, it is specified that Genki will also have to pay Nintendo a sum already privately agreed upon and which will not be disclosed to the public.
It is also true that the products initially shown by Genki turned out to be affected by some inaccuracies at the console's launch: this would support the thesis that the company had indeed worked on unofficial information and only after the release was able to modify its products. In any case, it seems that Genki has taken the agreement with Nintendo seriously, so much so that its pages now clearly state "not affiliated with, sponsored by, or endorsed by Nintendo".
